General communication - COVID 19: Guatemala, Honduras and El Salvador

As from April 13, 2020, the Patent and Trademark Office remains open. 

Legal terms following any decision or act by the PTO remain suspended until June 29th, 2020. Notifications of new oppositions, as well as any resolution which triggers a legal term and affects third parties’ rights remain suspended.

Regarding the computation of the judicial terms and deadlines, all remain legally suspended (except from certain constitutional injunctive proceedings). The activity of civil and criminal courts is limited to matters of urgent nature or constitutional matter

Mandatory general closure remains until Sunday, June 28th, 2020

The Honduran Trademark and Patent Office (PTO) continues to be closed. Therefore, all deadlines are in suspension

Notwithstanding, as from June 2nd, 2020, the following is available: 

-Filing of new trademark and patent applications electronically is now available.
-Filings regarding assignments, change of names or address.
-Trademark Annuity and maintenance fees.
-Trademark Searches. 

Regarding the computation of the judicial and administrative terms and deadlines, they remain suspended until June 28th, 2020

El Salvador

The Intellectual Property Registry (PTO) has resumed its activities and is open to the public as from June 16th, 2020

The filing of all type of applications is now possible, except for the consultation of physical records. 

Regarding the computation of administrative terms and deadlines, its computation is now continued as from June 16th, 2020, until the remaining days of the legal deadline in question concludes. Thus, the new legal deadline date will depend on the type of legal deadline and the date when the legal deadline began to be computed prior to March 16th, 2020. We encourage all to seek legal advise to determine the exact date of all such deadlines.
