Peru's IP industry cautions on joining WIPO agreements

The Peruvian Association of Industrial Property (APPI) is working on a proposal to set official legal parameters that guide the adherence of the country to international treaties on intellectual property.

Juan Carlos Durand Grahammer, member of APPI’s board of directors, said to El Peruano that a multidisciplinary specialized commission is necessary to evaluate the pros and cons for Peruvian creators, businesses, IP firms and professionals of joining such treaties.

On July 18, 2022, Peru deposited its instrument of ratification to the Geneva Act of the Lisbon Agreement on Appellations of Origin and Geographical Indication, which entered into force on October 18. The Geneva Act protects the distinctive designations of products in multiple jurisdictions, either as appellations of origin or geographical indications, through a application filed with WIPO. Peru also deposit its accession to four additional treaties: the Locarno, Nice, Strasbourg and Vienna Agreements.

WIPO currently administers 26 intellectual property treaties, 19 of which Peru is a member. The accession to the remaining 7 intellectual property treaties -including the Madrid Agreement regarding the international registration of trademarks- is still to be reviewed and analyzed.

During an official visit to Lima on October 4, WIPO Director General, Daren Tang, met with heads of the IP office to uptake of WIPO's Madrid System for the international registration of trademarks across the region.
